British Citizenship/Naturalisation

If you have obtained Indefinite Leave to Remain (ILR) in the UK, the next step may be to apply for British citizenship through naturalisation. Once your application is successful, you will become a British citizen, allowing you to apply for a British passport and enjoy the full rights and responsibilities of British citizenship.

Naturalisation is the legal process by which eligible adults become British citizens. Most applications are made after a qualifying period of lawful residence in the UK and once the relevant residence, English language and good character requirements have been met.

For many people, becoming a British citizen is the final step in their UK immigration journey. While you can continue to live and work permanently in the UK with Indefinite Leave to Remain, British citizenship offers additional benefits, including the right to hold a British passport and greater security of status.

The UK recognises dual nationality, although not every country does. Before applying, it is important to check whether your country of origin allows dual citizenship, as acquiring British citizenship could affect your existing nationality.

Our experienced immigration solicitors can advise you on your eligibility, guide you through the application process and help ensure your application is prepared as thoroughly as possible.

Who can apply for British citizenship?

Whether you are eligible to apply for British citizenship depends on your individual circumstances. Most applications are made by naturalisation after a person has obtained Indefinite Leave to Remain (ILR) or another form of settled status.

In most cases, you may be eligible to apply if you:

  • are aged 18 or over;

  • have held Indefinite Leave to Remain (or another qualifying form of settled status) for the required period;

  • meet the relevant residence requirements;

  • satisfy the good character requirement;

  • have sufficient knowledge of the English language;

  • have passed the Life in the UK Test, where required; and

  • intend to continue living in the United Kingdom.

Residence requirements

Most applicants must have lived lawfully in the UK for five years before applying for British citizenship.

As a general guide you should also:

  • have spent no more than 450 days outside the UK during the five-year qualifying period;

  • have spent no more than 90 days outside the UK during the 12 months immediately before your application;

  • have complied with UK immigration law throughout the qualifying period; and

  • hold settled status for the required period before making your application.

If you are married to or in a civil partnership with a British citizen, different residence requirements may apply and the qualifying period is often reduced to three years.

Good character

One of the most important parts of any citizenship application is satisfying the good character requirement.

The Home Office considers a number of factors, including criminal convictions, immigration history, financial conduct and whether you have complied with UK laws during your time in the UK.

If you have concerns about any aspect of your immigration history or personal circumstances, it is important to obtain legal advice before making your application.

English language and Life in the UK Test

Most applicants must demonstrate an appropriate knowledge of the English language and, unless exempt, pass the Life in the UK Test.

There are exemptions in certain circumstances, and we can advise whether these apply to your application.

Frequently Asked Questions

  1.  Who can apply for British citizenship?

You may be eligible to apply for British citizenship by naturalisation if you are over 18, hold Indefinite Leave to Remain or settled status, meet the residence requirements, are of good character, and satisfy the English language and Life in the UK requirements. The exact eligibility rules depend on your individual circumstances.

  1.  How long does a British citizenship application take?

Most applications are decided within around six months, although some applications may take longer depending on the complexity of the case or if the Home Office requires further information.

  1.  Do I need a solicitor to apply for British citizenship?

You are not required to instruct a solicitor, but professional advice can help ensure your application is prepared correctly, supported by the appropriate evidence and submitted with confidence. This can reduce the risk of delays or avoidable mistakes.

  1. How much does a British citizenship application cost?

Applying for British citizenship involves a Home Office application fee and, in most cases, the cost of attending a biometric appointment. If you choose to instruct a solicitor, there will also be professional fees for preparing and submitting your application. We will always provide a clear fixed-fee quotation before any work begins, and we can explain the current Home Office fees when you contact us.

  1. Can my British citizenship application be refused?

Yes. Applications can be refused if the eligibility requirements are not met or if the supporting evidence is insufficient. Careful preparation and ensuring the correct documents are provided can significantly improve your chances of success.

  1. Can a child apply for British citizenship?

Yes. Children can apply for British citizenship, but the rules are different from those that apply to adults. Eligibility depends on factors such as the child's age, immigration status, residence in the UK and the circumstances of their parents. We can advise on the most appropriate route and guide you through the application process.
